1. Introduction and Acceptance
Welcome to ACHRAMS, Nigeria's official FAAN-approved airport car hire service. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Passenger," "Driver" or "you") and ACHRAMS Nigeria Limited ("ACHRAMS," "we," "us," or "our"), governing your use of our car hire booking services, website, mobile application, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
1.1 Legal Capacity
You must be at least 18 years of age to use our Services. By using ACHRAMS, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
1.2 Service Description
ACHRAMS operates as an intermediary platform connecting passengers with FAAN-verified, licensed drivers at Nigerian airports. The ACHRAMS platform is designed, built, and powered by Excelian Technologies (http://exceliangroup.com.ng/).
Key Platform Features:
- Passengers can access the platform by scanning QR codes at designated airport locations
- Passengers can book as registered users or guests
- Drivers join a queue system and accept or reject trip requests
- Real-time trip tracking and security verification
- Driver wallet funding through FAAN Payment Gateway
- Emergency trip alert system
Important Payment Notice:
During the current pilot phase, fare payment from passengers to drivers occurs outside the ACHRAMS platform. Passengers pay drivers directly in cash or through other agreed methods. ACHRAMS does not process, facilitate, or hold passenger fare payments. The platform only facilitates driver wallet funding for commissions and platform-related fees through the FAAN Payment Gateway.
1.3 Platform Access
Passengers access the platform via:
- QR codes at airport arrival or departure areas
- Web URL: https://ride.achrams.com.ng
- Mobile applications (Android, iOS, PWA)
Drivers access the platform via the ACHRAMS Driver App.
2. Definitions
- "Platform" means the ACHRAMS website, mobile application (passenger and driver apps), QR code booking system, and all related digital interfaces
- "Driver" means FAAN-verified, licensed car hire operators registered with ACHRAMS
- "Passenger" means users booking transportation services through the platform
- "Trip" means transportation service from pickup to drop-off location
- "Booking" means a confirmed reservation for car hire services
- "User Account" means your registered profile on the Platform
- "FAAN" means Federal Airports Authority of Nigeria
- "Queue" means the driver waiting system for trip assignment
- "Security Code" means the unique verification code generated for each trip
- "Trip Alert" means the emergency notification system available during trips
- "Wallet Funds" means all monies stored in a driver's wallet within the ACHRAMS platform
- "FAAN Payment Gateway" means the payment gateway provided and operated by FAAN
- "Excelian" means Excelian Technologies Ltd, developer of the ACHRAMS platform
- "Pickup Location" means FAAN-designated taxi rank areas where passengers meet drivers
3. User Registration and Account
3.1 Account Creation
For Passengers:
- You may book as a guest using QR codes (no account required)
- You may create an account for additional benefits
- You must provide accurate, current, and complete information
- You are responsible for maintaining confidentiality of account credentials
For Drivers:
- You must create a driver account and complete FAAN verification
- You must provide valid FAAN credentials, driver's license, and vehicle documentation
- You must pass background checks
- You must maintain valid insurance coverage
- You must accept all platform terms, including the Indemnity and Wallet Funds clause (Section 19)
3.2 Account Responsibilities
- You are solely responsible for all activities under your account
- You must not share your account with others
- You must not create multiple accounts to abuse promotions or services
- Drivers must not share their driver accounts or allow unauthorized persons to use their credentials
- We reserve the right to suspend or terminate accounts that violate these Terms
3.3 Account Termination
You may close your account at any time by contacting support@achrams.com.ng. We may suspend or terminate accounts for violations of these Terms, fraudulent activity, or at our discretion with notice.
Driver Termination:
- Drivers with outstanding wallet balances must resolve all pending transactions before account closure
- FAAN Payment Gateway disputes must be settled independently of account closure
4. Booking Process
4.1 Passenger Booking Process
Step 1: Access Platform
- Scan QR code at airport baggage claim or departure area
- Access redirects to https://ride.achrams.com.ng
Step 2: Enter Trip Details
- Specify destination
- View estimated fare (based on taxi company standard rates)
- Select special requirements if needed (see Section 4.3)
Step 3: Confirm Booking
- Review trip details and estimated fare
- Submit trip request
Step 4: Driver Assignment
- System assigns trip to available driver in queue who accepts request
- Receive driver details: name, photo, vehicle information, license plate
- Receive unique Security Code for driver verification
Step 5: Navigate to Pickup
- Follow directions to designated FAAN pickup location
- Meet driver at specified taxi rank area
Step 6: Verify Driver
- Confirm driver photo matches
- Verify vehicle details and license plate
- Confirm Security Code with driver
- You may cancel if driver identity cannot be verified
Step 7: Complete Trip
- Board vehicle after successful verification
- Monitor trip via real-time tracking
- Use Trip Alert button if safety concerns arise
- Pay driver directly in cash upon trip completion
- Rate trip and provide feedback
4.2 Driver Process
Drivers follow a similar structured process through the ACHRAMS Driver App to receive and complete trips.
4.3 Special Requirements
Passengers may request the following during booking:
- Wheelchair access: Vehicle equipped with wheelchair accommodation
- Large luggage support: Extra trunk space or roof carrier
- Large vehicle: SUV or minivan for 5+ passengers
- Elderly assistance: Driver trained in elderly passenger assistance
- Child car seat: Available with advance request (subject to availability)
Special requirements are communicated to assigned drivers and must be accommodated. Additional charges may apply based on taxi company policies.
5. Pricing and Payment
5.1 Fare Estimates for Passengers
How Fare Estimates Work:
- Fares displayed are estimates based on standard rates provided by registered taxi companies
- Estimates consider distance and typical travel time
- Final fare paid to driver may vary from estimate due to:
- Actual traffic conditions
- Road diversions or closures
- Incorrect destination entered by passenger
- Passenger-requested detours or stops
- Waiting time at destination
Fare Transparency:
- No surge pricing
- Estimates shown before booking
- Variations are reasonable and justified by circumstances
- Disputes may be reported to support@achrams.com.ng
Payment Method (Current Pilot Phase):
- Passengers pay drivers directly in cash
- Payment occurs outside the ACHRAMS platform
- Platform does not process passenger fare payments
- Receipts (if required) are provided by drivers
5.2 Driver Wallet and Commission
Wallet Funding:
Drivers may fund their wallets using:
- Credit/Debit Cards (Visa, Mastercard, Verve)
- Mobile Money (approved Nigerian providers)
- Bank Transfers
FAAN Payment Gateway:
- All wallet funding is processed through the FAAN Payment Gateway
- FAAN operates and manages the payment gateway
- FAAN holds and manages all Wallet Funds
- Excelian provides technical platform support only and does not custody, control, or manage Wallet Funds
Wallet Uses:
- Payment of platform commissions
- Payment of FAAN fees
- Other platform-related charges
5.3 Additional Charges
Additional charges may apply for:
- Waiting time exceeding 15 minutes: ₦200 per 10 minutes
- Tolls and parking fees (actual costs)
- Excessive luggage requiring larger vehicle
- Passenger-requested detours after booking
- Cleaning fees: ₦2,000-₦5,000 for vehicle damage or excessive soiling
- Special requirements (as determined by taxi companies)
5.4 Receipts and Records
- Passengers receive booking confirmation via SMS and email
- Trip history available in passenger accounts
- Drivers maintain trip records in driver app
- For VAT receipts or invoices, contact taxi company directly
6. Cancellation and Refund Policy
6.1 Passenger Cancellations
- Free Cancellation: Up to 5 minutes after booking confirmation
- Cancellation Fee: ₦500 if cancelled 5-15 minutes after booking
- Full Charge: Cancellations after driver arrival or beyond 15 minutes
- No-Show: Full estimated fare charged if passenger does not appear within 10 minutes of driver arrival
Cancellation for Safety:
Passengers may cancel at any time without penalty if:
- Driver identity cannot be verified
- Security Code does not match
- Vehicle condition is unsafe
- Driver behavior is inappropriate
6.2 Driver Cancellations
- Drivers may reject trips before acceptance
- After acceptance, drivers should not cancel except for valid reasons:
- Vehicle breakdown
- Medical emergency
- Safety concerns
- Excessive cancellations after acceptance may result in account suspension
- Passengers receive full refund if driver cancels after acceptance
6.3 Refund Processing
- Refunds processed within 5-7 business days
- Refunds return to original payment method (for wallet-funded cancellation fees)
- Disputes may be reported to support@achrams.com.ng
- Processing time: 7-14 business days for investigations
7. User Conduct and Prohibited Activities
7.1 Passenger Conduct
You agree to:
- Treat drivers with respect and courtesy
- Provide accurate destination information
- Be ready at designated pickup location
- Verify driver identity using Security Code
- Pay agreed fare to driver upon trip completion
- Follow all applicable laws during the trip
- Not damage or vandalize the vehicle
- Not engage in illegal activities
- Use Trip Alert button responsibly for genuine emergencies only
7.2 Driver Conduct
You agree to:
- Maintain professional, courteous behavior
- Accept or reject trips promptly
- Arrive at pickup location on time
- Allow passenger to verify your identity
- Accommodate special requirements
- Follow optimal routes
- Maintain vehicle cleanliness and safety
- Collect fares professionally and provide receipts if requested
- Comply with all traffic laws and FAAN regulations
- Report safety concerns immediately
7.3 Prohibited Activities
For All Users:
- Use Services for illegal purposes
- Harass, threaten, or abuse other users
- Provide false information
- Manipulate or abuse the booking system
- Attempt to bypass payment systems
- Reverse engineer or compromise the Platform
- Use automated systems or bots
For Passengers:
- Transport illegal goods, weapons, or hazardous materials
- Exceed vehicle passenger capacity
- Smoke in vehicles (unless permitted by driver)
- Consume alcohol or drugs in vehicles
- Falsely activate Trip Alert button
For Drivers:
- Accept trips while unfit to drive
- Operate uninsured or unsafe vehicles
- Overcharge passengers beyond reasonable fare adjustments
- Provide inaccurate vehicle information
- Share driver account credentials
- Accept trips outside designated FAAN areas
7.4 Consequences of Violations
Violations may result in:
- Immediate trip termination
- Account suspension or permanent ban
- Financial penalties
- Legal action and liability for damages
- Referral to law enforcement or FAAN authorities
- Driver removal from FAAN-approved list
8. Safety and Security
8.1 Security Code Verification System
- Each trip generates a unique Security Code
- Passengers receive Security Code with driver details
- Passengers must verify Security Code with driver before boarding
- Do not board if Security Code does not match
- Report mismatched codes immediately to support
8.2 Trip Alert System
- Trip Alert button available during all trips
- Press to send immediate alert to:
- ACHRAMS support team
- FAAN security
- Designated emergency contacts
- Use only for genuine safety concerns
- Misuse may result in account suspension
8.3 Real-Time Tracking
- All trips include GPS tracking
- Passengers can share trip details with family/friends
- Tracking available to FAAN and ACHRAMS for safety monitoring
- Tracking data used for dispute resolution
8.4 Driver Verification
All drivers undergo:
- FAAN background checks and credential verification
- Criminal record verification
- Driving license validation
- Vehicle safety inspections
- Regular performance monitoring
8.5 Reporting Safety Concerns

8.6 Pickup Location Safety

- Include trip details and item description
- We will contact the driver to attempt recovery
- We are not liable for lost or stolen items
- Recovery fees may apply: ₦1,000-₦3,000
9. Driver Obligations and Standards
9.1 Driver Requirements
All drivers must:
- Hold valid FAAN-approved airport access credentials
- Possess valid Nigerian driver's licenses
- Maintain vehicle safety and cleanliness standards
- Undergo regular background checks
- Maintain appropriate insurance coverage
- Complete ACHRAMS driver training
- Accept Indemnity and Wallet Funds clause (Section 19)
9.2 Queue System Compliance
- Drivers must follow fair queue system
- Accept or reject trips within allocated time
- Maintain online status accuracy
- Do not abuse queue position
9.3 Vehicle Standards
- Vehicles must meet FAAN safety requirements
- Regular maintenance required
- Clean interior and exterior
- Functioning air conditioning
- Valid vehicle registration and insurance
- Proper display of identification
9.4 Driver Accountability
Drivers who violate standards may face:
- Suspension or removal from the platform
- Fines or penalties
- Reporting to FAAN authorities
- Loss of FAAN credentials
- Legal action
10. Limitation of Liability
10.1 Service Disclaimer
ACHRAMS provides a platform connecting passengers with independent drivers. We are not:
- A transportation carrier
- Responsible for driver actions or omissions
- Responsible for fare collection or disputes
- Liable for accidents, injuries, or damages during trips
- Guaranteeing service availability at all times
- Responsible for FAAN Payment Gateway operations
10.2 Disclaimer of Warranties
Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy of fare estimates
10.3 Limitation of Damages
To the maximum extent permitted by Nigerian law, ACHRAMS shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount paid for platform services
- Acts or omissions of drivers, including accidents, injuries, or property damage
- Fare disputes between passengers and drivers
- FAAN Payment Gateway issues (see Section 19)
10.4 Independent Contractors
Drivers are independent contractors, not employees or agents of ACHRAMS. We are not liable for their actions, negligence, or misconduct. Fare payment agreements are directly between passengers and drivers.
11. Indemnification
You agree to indemnify, defend, and hold harmless ACHRAMS, Excelian Technologies, their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any laws or rights of third parties
- Your conduct during trips
- Disputes with other users
- Fare payment disputes (for passengers)
- Wallet fund disputes (for drivers - see Section 19)
12. Insurance
12.1 Driver Insurance
Drivers are required to maintain:
- Valid third-party motor vehicle insurance
- Comprehensive coverage (recommended)
- Passenger liability insurance
- Insurance must meet FAAN requirements
12.2 Passenger Insurance
You are responsible for obtaining your own:
- Travel insurance
- Personal accident insurance
- Health insurance
ACHRAMS does not provide insurance coverage for passengers.
13. Intellectual Property
13.1 Ownership
All intellectual property rights in the Platform, including trademarks, logos, brand names, software, code, algorithms, content, design, graphics, and user interface are owned by ACHRAMS, Excelian Technologies, or our licensors.
13.2 Platform Technology
The ACHRAMS platform is designed, built, and powered by Excelian Technologies (http://exceliangroup.com.ng/). All technology rights, including software, source code, and technical infrastructure, are the property of Excelian Technologies.
13.3 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Platform for personal or professional purposes (drivers) only.
13.4 Restrictions
You may not:
- Copy, modify, or distribute our intellectual property
- Reverse engineer the Platform
- Remove or alter proprietary notices
- Use our brand or trademarks without written permission
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@achrams.com.ng to attempt informal resolution.
14.2 Arbitration
Any disputes not resolved informally shall be settled by arbitration in accordance with the Arbitration and Conciliation Act (Cap A18) Laws of the Federation of Nigeria 2004.
14.3 Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal action shall be brought exclusively in the courts of Nigeria.
14.4 Exceptions
The following disputes are excluded from arbitration and may be brought directly in court:
- Emergency safety matters
- Intellectual property infringement
- Criminal activities
15. Force Majeure
We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including:
- Natural disasters
- War, terrorism, or civil unrest
- Government actions or regulations
- Strikes or labor disputes
- Technical failures or power outages
- Pandemics or health emergencies
- FAAN operational issues or airport closures
16. Modifications to Terms
16.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be effective upon:
- Posting on our website
- Notification via email or in-app message
- Your continued use of Services after changes
16.2 Material Changes
For material changes, we will provide at least 30 days' notice. Your continued use after this period constitutes acceptance.
16.3 Driver Notification
Drivers will receive specific notification of changes to Section 19 (Indemnity and Wallet Funds) and must re-accept before continuing to use the platform.
17. Miscellaneous Provisions

17.1 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ACHRAMS.

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

These Terms do not confer rights on any third parties except as explicitly stated in Section 19.

Provisions that by their nature should survive termination (including indemnification, limitation of liability, dispute resolution, and Section 19) shall survive.

19. INDEMNITY AND WALLET FUNDS (FAAN PAYMENT GATEWAY)
IMPORTANT: All drivers must read and accept this section before registration on the ACHRAMS platform. This section governs Wallet Funds, FAAN Payment Gateway usage, and associated liabilities.
19.1 Definitions
For purposes of this section:
- "Wallet Funds" means all monies stored in any driver's wallet within the ACHRAMS App, including commissions, fare receipts, top-ups, credits, or any related balances.
- "FAAN Payment Gateway" means the payment gateway provided and operated by the Federal Airports Authority of Nigeria ("FAAN") through which all commissions and wallet fundings are deposited.
- "Excelian" means Excelian Technologies Ltd, technology company and developer of the ACHRAMS App.
19.2 Allocation of Responsibility
The Parties acknowledge and agree that:
- The FAAN Payment Gateway is provided and operated by FAAN
- All Wallet Funds are deposited with and held/managed by FAAN
- Excelian acts solely as the platform developer and provider of technical support
- Excelian does not custody, control, manage, reconcile, or directly hold Wallet Funds
- All wallet transactions are processed through FAAN's payment infrastructure
- FAAN has sole responsibility for payment gateway operations, security, and fund management
19.3 Driver Indemnity
To the fullest extent permitted by applicable law, the driver (including drivers, fleet owners/operators, and account holders) agrees to indemnify, defend and hold harmless Excelian and its officers, directors, employees, agents, affiliates and contractors from and against all claims, losses, liabilities, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or relating to:
a) Wallet Fund Disputes:
- Any dispute, claim, refund request, reconciliation, chargeback, error, unauthorized transaction or other matter concerning Wallet Funds
- Delays in wallet funding or withdrawals
- Discrepancies in wallet balances
- Failed or incomplete transactions
b) FAAN Payment Gateway:
- The operation, performance, availability, security, errors or failures of the FAAN Payment Gateway
- FAAN's handling of Wallet Funds
- Any technical issues with payment processing
- Payment gateway downtime or service interruptions
c) FAAN Actions:
- Any acts or omissions of FAAN in connection with Wallet Funds
- FAAN policies regarding wallet management
- FAAN decisions on refunds, chargebacks, or fund holds
- Changes to FAAN Payment Gateway terms or operations
d) Financial Obligations:
- Any taxes, fees, or third-party claims related to Wallet Funds or payment processing
- Banking fees or currency conversion charges
- Transaction processing fees imposed by FAAN
19.4 Excelian Right to Defense
Excelian may, at its option, assume and control the defense of any such claim, and the indemnifying party shall cooperate in that defense and shall not settle any claim on terms that would impose obligations or liability on Excelian without Excelian's prior written consent.
19.5 Limitation and Exclusion of Liability
Except to the extent caused by Excelian's gross negligence or willful misconduct:
a) No Liability for Wallet Funds:
Excelian shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits or loss of data, arising out of or related to:
- Wallet Funds
- The FAAN Payment Gateway
- FAAN's management of Wallet Funds
This applies even if Excelian has been advised of the possibility of such damages.
b) Direct Claims to FAAN:
All claims relating to Wallet Funds must be directed to FAAN. Excelian disclaims responsibility for FAAN's decisions on:
- Refunds
- Reconciliations
- Chargebacks
- Fund holds or freezes
- Wallet balance adjustments
- Withdrawal processing
c) Technical Support Only:
Excelian's role is limited to providing technical platform support. Excelian:
- Does not guarantee FAAN Payment Gateway uptime or performance
- Is not responsible for payment gateway security breaches originating from FAAN systems
- Cannot reverse, adjust, or modify wallet transactions
- Cannot access or retrieve Wallet Funds on behalf of drivers
19.6 Claims Procedure and Cooperation
a) Driver Obligations:
Users must promptly notify FAAN of any concern, dispute or claim regarding Wallet Funds in accordance with FAAN's procedures. Drivers should:
- Document all wallet transactions
- Maintain records of funding and withdrawals
- Report discrepancies to FAAN immediately
- Follow FAAN's dispute resolution procedures
b) Notice to Excelian:
Users shall give Excelian prompt written notice (within 7 days) of any third-party claim for which indemnity may be sought under this section.
c) Cooperation:
Users shall provide reasonable assistance and cooperation to Excelian in the defense or resolution of such claims, including:
- Providing relevant documentation
- Participating in meetings or proceedings
- Sharing communications with FAAN
- Not admitting liability without Excelian's consent
19.7 No Warranty on Payment Gateway
Excelian makes no representations or warranties regarding:
- The FAAN Payment Gateway's availability, reliability, or security
- The timing of wallet fund deposits or withdrawals
- The accuracy of wallet balance displays
- FAAN's compliance with financial regulations
- The resolution of payment disputes
Drivers use the FAAN Payment Gateway at their own risk and agree that Excelian has no liability for payment gateway performance.
19.8 Driver Acknowledgment
By accepting these Terms and creating a driver account, you explicitly acknowledge that:
- You understand Wallet Funds are held and managed by FAAN, not Excelian
- You accept full responsibility for all wallet-related disputes
- You will indemnify Excelian for any claims related to Wallet Funds
- You will direct all payment concerns to FAAN
- You release Excelian from any liability related to the FAAN Payment Gateway
- You understand Excelian's role is limited to technical platform provision
19.9 Survival and Severability
a) Survival:
This section survives termination or expiration of these Terms & Conditions. Even after your driver account is closed, this indemnity remains in effect for:
- Any pending wallet disputes
- Any claims arising from past transactions
- Any historical wallet activity
b) Severability:
If any provision of this section is held invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect to the maximum extent permitted.
19.10 Governing Law for This Section
This section is governed by the laws of the Federal Republic of Nigeria and shall be interpreted to provide maximum protection to Excelian as permitted by Nigerian law.
19.11 Acceptance Requirement
DRIVERS CANNOT PROCEED WITH REGISTRATION WITHOUT ACCEPTING THIS SECTION.
By clicking "I Accept" or proceeding with driver registration, you confirm that you have read, understood, and agree to be bound by all terms in this Section 19.
20. ACKNOWLEDGMENT
BY CLICKING "I AGREE," SCANNING A QR CODE TO BOOK, OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
DRIVERS: You specifically acknowledge acceptance of Section 19 (Indemnity and Wallet Funds) as a condition of platform access.
